Wombie Gear Terms of Service

These terms apply when you use the Wombie Gear website (wombiegear.com.au) and when you buy from us. Wombie Gear is a brand of 3am Ideas Pty Ltd (ABN 97 356 751 261), based in Perth, Western Australia. In these terms, "we", "us" and "our" mean 3am Ideas Pty Ltd trading as Wombie Gear.

By using our website or placing an order, you agree to these terms. If you do not agree, please do not use the site.

Who can order

To place an order, you need to be at least 18 years old and able to enter into a binding contract.

Products and pricing

We do our best to describe and show our products accurately. Colours and packaging may vary slightly from the images on screen.

All prices are in Australian dollars and include GST where it applies. Shipping is calculated and shown at checkout. We may change prices, products and promotions at any time, but changes will not affect orders we have already accepted.

Orders

When you place an order, you are making an offer to buy. Your order is accepted once we send you a confirmation. We may decline or cancel an order, for example if an item is out of stock, if there has been a pricing error, or if we suspect fraud. If we cancel an order you have already paid for, we will refund you in full.

Payment

Payment is taken at checkout through our payment providers. You confirm that you are authorised to use the payment method you provide.

Delivery and returns

We deliver and handle returns as set out in our Shipping Policy and our Returns and Refund Policy, which form part of these terms.

Your consumer rights

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits those rights. You can read more in our Returns and Refund Policy.

Intellectual property

Everything on our website, including our brand name, logo, images, text and design, belongs to us or our licensors. You may not copy, reproduce or use any of it without our written permission.

Using our website

You agree to use our website lawfully, and not to interfere with it, attempt to gain unauthorised access, or use it in a way that could damage or disrupt it.

State of emergency

Wombie Gear products and website are not intended for use with life-critical or safety-critical systems, such as the operation of medical equipment, automated transportation systems, autonomous vehicles, aircraft or air traffic control, nuclear facilities, manned spacecraft, or military use in connection with live combat.

This restriction will not apply in the event of the occurrence (certified by the Australian Centre for Disease Control or successor body) of a widespread viral infection transmitted via bites or contact with bodily fluids that causes human corpses to reanimate and seek to consume living human flesh, blood, brain or nerve tissue and is likely to result in the fall of organised civilisation.

Our liability

We stand behind our products and your rights under the Australian Consumer Law. To the extent the law allows, we are not liable for any indirect or consequential loss arising from your use of our website or products. Nothing in these terms excludes any liability that cannot be excluded by law.

Changes to these terms

We may update these terms from time to time. The current version will always be on this page, with the date it was last updated. By continuing to use our site, you accept any updated terms.

Governing law

These terms are governed by the laws of Western Australia, and you agree to the jurisdiction of the courts of Western Australia.
